Property Financial Planning


Property loan has become an essential financial product whenever we need to fund our purchase of a new or sub-sale property or re-finance our existing property loan to restructure our debt or generate working capital for personal or business use.
However, selection of the right package that is suitable for your needs is very important. Hence, there are a few clues before you select your property loan package:-


Assessing The Requirements


  1. Your objective (funding new purchase or refinancing - cash out or not)
  2. Type of property (landed property or apartment/condominium) and location
  3. Leasehold or freehold
  4. Margin of loan
  5. Current total fixed household expenses per month
  6. Be watchful of healthy debt maintenance ratio (range 40% or below is preferred by financial institutions)
  7. If you have high fixed household expenses or high debt maintenance ratio, which are both unfavorable to secure a home loan under your personal name, then you should get a joint applicant (e.g. spouse) to prove a better combined income.

If you don't have big amount of down payment, you may consider to withdraw your Employees Provident Fund EPF Account II for your down payment, which has its criteria and maximum eligibility of withdrawal.
Based on the few factors and advices mentioned above, you shall able to justify your cash flow in serving the repayment later.


Documents Required For Loan Application


Make sure you have proper financial documents to support your application such as:-
  1. Loan application form
  2. Photocopy of I/C of all applicants (Front & Reverse)
  3. Latest J form / Borang B or BE (last 2 years)
  4. Pay slips for the last 3 months
  5. Copy of S & P Agreement/deposit or booking receipt/letter of offer from the housing developer
  6. A photocopy of the land title (if any)
  7. The bank account statements (saving passbook/fixed deposits/current account statement) for the last 6 months
  8. Valuation report for completed house
  9. Latest statement of your existing home loan (for refinancing)

Additional documents to support if required:-
  1. Latest EPF Statements
  2. Confirmation Letter on current salary from employer
  3. If you are self employed, you need to provide your business registration documents, latest business financial statements, 3 months business' bank statements, and other supporting documents to support your income.

ILLEGAL ESTATE AGENTS


 
"ILLEGALS" as defined in the "The Valuers, Appraisers & Estate Agents Act 1981" restrictions on Estate Agency Practice - Section 22C states; No person shall unless he is a Registered Estate Agent practice or carry on business or take up employment as an Estate Agent under any name style or title containing the words "Estate Agent", "House Agent", "Property Agent", "Land Agent" or to the equivalent thereto, in any language or bearing any other word whatsoever in any language which may reasonably be construed to imply that he is a Registered Estate Agent." 
 
ANYONE OTHER THAN AN ESTATE AGENT CANNOT:
  • Use or display any sign board, card or other device representing or implying that he is a Registered Estate Agent;
  • Be entitled to recover in any court any fees, charges or remuneration for any professional advice or services rendered as an Estate Agent."
THE CONVICTION
 
"ANYONE WHO COMMITS AN OFFENCE IS LIABLE ON CONVICTION TO A FINE NOT EXCEEDING RM25,000 OR TO AN IMPRISONMENT FOR A TERM NOT EXCEEDING 3 YEARS OR BOTH AND SHALL BE LIABLE TO A FURTHER PENALTY OF RM500 FOR EACH DAY DURING THE CONTINUANCE OF SUCH OFFENCE". 
 
CLIENT'S ACCOUNT
Estate Agents are permitted by law to collect pahyments from clients in the name of the Real Estate firms and deposit such sums of monies in a "Client's Account". The deposit will be held by the Estate Agents as a stake Holder until the SPA is signed and/or until completion of the sale. Estate Agents are required to have a Professional Indemnity Insurance to protect the interest of their clients. 
 
 
 
 
WHAT IS AN "E" NUMBER
Every Etate Agent is assign with a number e.g. E1379 which reflects the individual Estate Agent whose name has been registered with the Board. On the other hand the firm is issued with another registration number e.g. E(3)1188 for sole prioprietorship and E(1)1329 for Sendirian Berhad.

These Registration numbers are required to be displayed in all communication tools of the firm.

The Estate Agency Profession & Practice.


THE REAL ESTATE PROFESSION
The Real Estate Profession comes under the purview of the Ministry Ministry of Finance and is regulated by The Board of Valuers, Appraisers & Estate Agents, Malaysia and governed by the Valuers, Appraisers & Estate Agents Act 1981, the Rules 1986 and The Standards 
 
ESTATE AGENCY PRACTICE?
It means acting or holding oneself out to the Public as ready to act, for a commision, fee, reward or other consideration as an agent in respect of the sale or other disposal of land and buildings and of any interest therein or the purchase or other acquisition of land & buildings and of any interest thereon or in respect of the leasing or letting of land and buildings and of any interest therein. 
 
WHO IS AN ESTATE AGENT?
Means a person whose name has been entered under Part III of the Register and to whom an Authority off Practice has been issued by the Board of Valuers, Appraisers & Esstate Aegnts under Section 16 of the Act.
 

WHO IS NEGOTIATOR?
A negotiator is a real estate salesperson employed by a real estate agent. All negotiators are required to work on a full time basis with a real estate firm. 
 
C.R.E.N. (CERTIFIED REAL ESTATE NEGOTIATORS)
To raise the standard of prefessionalism the Malaysian Institute of Estate Agents have registered Negotiators and they are called Certified Real Estate Negotiators and they carry a cerification card. Please insist on looking at the card when appointing a Negotiator to represent you. 
 
PROFESSIONAL FEES CHANGEABLE BY AN ESTATE AGENT UNDER THE SEVENTH SCHEDULE, RULE 48
FOR SALE OR PURCHASE OF LAND AND BUILDING
  • 2.75% on the first RM500,000 and
  • 2% on the residue over RM500,000
FOR LETTINGS
  • Tenancy up to 3 years
  • Exceeding 3 years up to 4 years
  • Exceeding 4 years up to 5 years
  • 1.25 months gross rental
  • 1.50% months gross rental
  • 1.75% months gross rental
RENT REVIEW
  • 50% of the fees chargeable under lettings(This is for renewal of Tenancy Agreements)
Claims
Claims are allowed for travelling, printing, copies of documents, advertisements, sign boards, etc.
* Esstate Agents can collect fees from one party only i.e either the Seller/Landlord or Buyer/Tenant
 
SERVICE TAX
All Real Estate firms are required by law to collect 5% service tax on professional fees payable by the clients and it is compulsory for those using the services to pay the service tax which will be forwarded to the Customs Department by the Real Estate firm.

MESSAGE FROM THE PRESIDENT OF MIEA

The first ever collaboration between MIEA and the National Association Realtors of America (NAR) was to partake in a Convention in year 2000 and from there on, the annual convention from MIEA was born.  Subsequently the MIEA Convention was renamed  MAREC.  Today, MAREC remains the single biggest Real Estate Convention in this country for Real Estate professionals!

The purpose of the Convention is to stimulate and to empower the Real Estate practitioners towards goal achievement with the key focus to excel further in their own estate agency.  In our MAREC Convention, our principal aim is to teach members to work less and earn more, achieve higher goal and goal setting and lastly learn how to build more profit, more predictably.  It is also a superb opportunity for networking amongst the practitioners.  Principal members know our Convention strive to give our very best each year to them and even though costs have risen but we still maintain very competitive rates just for our members' benefit.

Our Convention is able to attract more than 500 participants each year.  For a couple of years now, we also conduct parallel programmes specially designed for negotiators to teach them how to manage their time well, having a good system for managing daily activities, maintaining steady portfolio of sellers/buyers, attending meetings and learning how to communicate well.

The difference in this year's Convention for the negotiators is that we are inviting the experts who have extensive knowledge and experience in their respective fields and are willing to share thier knowledge and expertise exclusively with our negotiators.

Further, we have invited renowned American speakers over to give us a talk and to share with us the scenario of the global real estate, whether it is at its slow climb or at a recovering phase.

The theme "The Millionaire Real Estate Agent" is not meant only for the real estate practitioners but we are also open to the public because the pointers given by the speakers and our carefully selected topics are designed for all who want to have a better understanding of the property marketplace and who would like to equip themselves with the proper knowhow.  As for the public, the price of Ringgit 800 is for a two day event with 2 buffet teas and a sumptous lunch daily thrown in - who can ask for a better deal?  It is my sincere hope that the public and real estate practitioners, members and non-members alike will be interested to come in droves just to learn the fine pointers from persons who are already at millionaire status.
